The Court of Justice of the European Union issued a decision declaring Hungary’s online gambling legislation incompatible with the EU’s freedom to provide services. The case relates to a request for a preliminary ruling from the Administrative and Labour Court in Budapest and concerned administrative decisions made by the Hungarian authorities to block access to the operator Unibet’s sites in the country, where the latter offered online games of chance without having obtained a licence in Hungary. The court stated that the local legislation licensing requirement to carry out, for a period of at least 10 years, an activity involving the organization of games of chance in Hungary, is discriminatory (ECJ Case C-49/16).
