The Warsaw office of PETERKA & PARTNERS has successfully represented a Hong-Kong-based company in a complex cross-border commercial dispute against a Polish defendant, resulting in a court-mediated settlement and recovery for our client. The matter was led by Filip Gosztyła.

The dispute concerned unpaid invoices arising from a series of sales agreements for goods delivered to Germany. The case had a distinctly international character, involving parties and legal elements from several jurisdictions.

The claimant, a company seated in Hong Kong, pursued its claims under contracts governed by the law of the Hong Kong Special Administrative Region of the People’s Republic of China. At the same time, the dispute involved a Polish counterparty and commercial deliveries carried out in Germany, adding further jurisdictional and practical complexity.

The matter was also complicated by corporate links between the parties and other companies within the same international group. Several related disputes and mutual claims between affiliated entities formed a broader background to the case.
