PETERKA & PARTNERS Slovakia is delighted to have been able to assist Podtatranska vodarenska prevadzkova spolocnost (member of the VEOLIA group) in winning significant lawsuit concerning compensation for material damage due to restricted use of land in water resource protection zones according to the Water Act. We represented the client before regional and district courts and the Supreme Court, after which, the regional court made the final decision. The lawsuit was of strategic importance for the client with regard to the significant sum sued. The outcome of it may also have an impact on other water management companies in Slovakia since the issue of compensation for material damage due to restricted use of land in water resource protection zones goes beyond the client’s interests and concerns all water management companies which use water from water resources in protection zones.
