The Warsaw office of PETERKA & PARTNERS has obtained for our client – a producer of innovative fuel based on the recycling of waste materials – a judgment from the National Appeal Chamber, stating that a contract concluded within a public tender with a value of PLN 1.7 million has been annulled.
The PETERKA & PARTNERS advisory before the National Appeal Chamber was a part of a dispute regarding the use of the real properties on which the client’s raw material for production of fuel is deposited, and challenging a third party’s unlawful breach of the client’s property. Our advisory involves representing the client in a common court in a court case related to breach of the client’s possession, and before administrative and enforcement bodies, in cases related to breach of possession. We have also obtained a court injunction prohibiting the third party from breach of the client’s possession.
