An article by Rostislav Frelich, Tax Advisor and Member of the PETERKA & PARTNERS Tax Desk will be published in the TerraLex Connections January/February 2018 General Topic Edition. In the article Mr. Frelich describes how and when double tax treaties will be modified by the Multilateral Instrument (MLI) which was signed by 70 jurisdictions. Over 1,100 bilateral tax treaties worldwide will be modified in a synchronized and efficient manner without standard negotiations and long-term approval procedures. This makes the MLI a unique and unprecedented measure. In many countries no consolidated version of modified treaties will be available. In this context, prior to applying double tax treaties, taxpayers should pay special attention to this newly-introduced OECD measure in order to determine whether, and how, a particular tax treaty has been amended by the MLI.
