Starting from 1 March 2022, companies which withhold and fail to pay payroll duties and/or contributions within 60 days from the due date are risking criminal penalties, as the provisions of Emergency Ordinance no. 130/2021 came into effect.
Therefore, from 26 June 2022 onwards, criminal complaints started to be filed by the National Agency for Fiscal Administration (ANAF) against companies that failed to fulfil their fiscal obligations stipulated by Emergency Ordinance no. 130/2021.
According to the latest declarations of the President of the ANAF, by the middle of September 2022, more than 50,000 complaints have been filed against active tax payers, reaching a debt of more than 350 million lei.
