We would like to share with you that the recent success achieved by our combined real estate and litigation teams in Warsaw! Our colleagues from Warsaw office: Beata Składanek-Wikieł, Leader of Litigation in Poland and Sławomir Patkowski, Partner, Deputy Director for Poland have obtained a precedent judgment of the Supreme Administrative Court in which the court recognized a diplomatic mission as a party to administrative proceedings concerning a building permit on real property in the near vicinity of the mission. We managed to derive legal interest to participate in the proceedings directly from the Vienna Convention on Diplomatic Relations.
The direct procedural effect of the judgment is that the relevant administrative body is obliged to recognize the Client’s appeal against the decision on the building permit. The broader significance of this judgment is to demonstrate that the parties to the proceedings for granting a building permit can be extended beyond the entities listed as parties in the Construction Law.
